Denver judge rejects last-minute effort to cancel vote on graduated income tax measure

This story was first published at Colorado Newsline. DENVER A judge in Denver has dismissed an attempt by conservative opponents of a graduated income tax proposal to invalidate the measure on ballots already in Colorado voters. The opposition argued that votes on Amendment 87 shouldn't be counted due to paperwork issues with some of the entities that circulated petitions for the measure. Judge Heidi L. Kutcher of the Denver District Court stated that the failure by some circulators to comply with an administrative rule established by the Colorado secretary of state’s office doesn’t outweigh Coloradans’ fundamental right to participate in the initiative process. Amendment 87, which would raise income taxes on the top 3% of Colorado earners and slightly cut them for everyone else, qualified for the ballot last month after the secretary of State’s Office determined proponents had submitted 130,938 valid signatures, exceeding the required threshold of 124,238 valid signatures.
